Art of K-Tips Intellectual Property & Terms of Use Agreement

Effective Upon Date of Purchase

This Agreement (“Agreement”) is entered into between the individual enrolling in the course (“Student” or “You”) and:

Organization (if applicable): HairByEster, Hairbyesteredu LLC

By accessing or participating in the Art of K-Tips online course you agree to the following terms and conditions.

1. Intellectual Property Ownership

All materials provided through this course—including but not limited to videos, slides, audio, graphics, text, and other content (“Course Content”) - are the sole property of the Instructor and are protected by copyright, trademark, and other intellectual property laws.
You acknowledge that a) You are being granted a limited, personal, non-transferable, non-exclusive license to access and use the Course Content solely for your own educational use b) you do not gain any ownership rights to the Course Content by participating in the course or paying course fees.

2. No Recording or Redistribution Policy

You agree that you will not record, download, screen capture, distribute, copy, reproduce, republish, upload, or transmit any part of the Course Content by any means, including but not limited to screen recording software, browser extensions, or mobile recording. You may not host course content (or any derivatives of it) on third-party platforms, social media, or learning platforms such as, but not limited to, YouTube, Instagram, TikTok, Udemy, or Teachable. Violation of this policy may result in immediate termination of access, without refund, and may result in legal action.

3. Nondisclosure Agreement (NDA)

You agree to maintain the confidentiality of all proprietary, instructional, and behind-the-scenes information disclosed during the course, including but not limited to:
- Teaching methods, frameworks, tools, techniques;
- Non-public videos, unreleased drafts, or bonus content; and
- Other students’ contributions, work, or discussions.
You will not share this information with third parties, nor use it for any purpose other than your own private learning, without prior written permission from the Instructor.

4. Prohibited Uses

You may not:
- Share your login credentials with anyone;
- Use course content for commercial, consulting, or training purposes;
- Reproduce or adapt course material for resale, inclusion in your own programs, or redistribution; and
- Circumvent any access controls or digital rights management (DRM) protections on the course platform.

5. Termination of Access

Violation of any part of this Agreement may result in:
- Immediate suspension or termination of course access;
- Legal action, including injunctions and claims for damages; and
- 
Reporting to the platform hosting the course.

6. Disclaimers & Limitation of Liability

The Course is provided for general educational purposes only. The Instructor makes no guarantees regarding your personal or business outcomes. In no event shall the Instructor or Organization be liable for any indirect, incidental, special, or consequential damages arising out of your participation.

7. Governing Law

This Agreement shall be governed by the laws of the State/Province of New York. Any disputes shall be resolved in the courts located in New York.

8. Acceptance of Terms

By clicking “I Agree,” enrolling in the course, or accessing the materials, you confirm that you have read, understood, and agree to be bound by the terms of this Agreement.
