Terms of Service

These Terms of Service (Terms) are a legally binding agreement between you and HairByEster Education (HairByEster, we, us, our). By purchasing, enrolling in, accessing, or attending any HairByEster Education offering, including in person trainings, live classes, workshops, virtual courses, digital products, downloadable materials, communities, or subscriptions (collectively, the Education Services), you agree to these Terms. 

If you do not agree, do not purchase, enroll, access, or attend. 

 

  1. Professional Eligibility and Licensing Assumption 

1.1 The Education Services are intended for licensed cosmetologists and licensed beauty professionals only. 

1.2 By enrolling or attending, you represent and warrant that you are a currently licensed cosmetologist or otherwise properly licensed to perform hair services in your jurisdiction. 

1.3 All attendees are assumed to be licensed cosmetologists. We do not provide basic licensure training, and we do not assume responsibility for unlicensed practice. 

1.4 You are solely responsible for complying with all applicable laws, regulations, and licensing requirements in your state or country. 

 

  1. Eligibility and Account Responsibility 

2.1 You represent that you are at least 18 years old and able to enter into a binding contract. 

2.2 If the Education Services include an online account, you agree to provide accurate information and to keep it current. 

2.3 You are responsible for maintaining the confidentiality and security of your login credentials and for all activity under your account. 

2.4 Login sharing is prohibited. Your enrollment is for one individual user only. You may not share, transfer, sublicense, sell, or allow any other person to access your account, course portal, downloads, or community access. 

2.5 You must notify us immediately if you suspect unauthorized access. We may suspend or terminate access to protect the Education Services and our intellectual property. 

 

  1. Purchases, Payment Plans, and Taxes 

3.1 Pricing, payment options, and what is included with your purchase are described at checkout or on the applicable sales page, and those details are incorporated into these Terms by reference. 

3.2 If you select a payment plan, you authorize us and our payment processors to charge the payment method on file according to the schedule presented at checkout.

3.3 Failure to complete a payment plan is a material breach of these Terms. We may suspend access to any digital materials, cancel your seat, and pursue collection of the remaining balance to the fullest extent permitted by law. 

3.4 You are responsible for any applicable taxes, duties, or bank fees associated with your purchase. 

 

  1. All Sales Final, No Refunds, No Transfers, No Rescheduling 

4.1 All sales are final. No refunds are issued for any reason, including but not limited to schedule conflicts, travel issues, illness, emergencies, dissatisfaction, inability to attend, or changes in personal or business circumstances. 

4.2 No transfers, rescheduling, substitutions, credits, or rollovers are permitted. Your enrollment is specific to you and the selected cohort, date, and format. 

4.3 You agree not to initiate chargebacks or payment disputes as a substitute for requesting support. If a chargeback is initiated, we may suspend access immediately while we investigate, and we may require repayment of access value, chargeback fees, and collection costs as permitted by law. 

 

  1. Our Right to Modify, Reschedule, or Cancel 

5.1 We reserve the right to modify instructors, curriculum flow, location, start and end times, or materials when reasonably necessary. 

5.2 If we cancel an in person class or live program, we will issue a refund of the amounts you paid to us for that specific Education Service. Refunds are limited to amounts actually received by HairByEster for the applicable program and do not include travel, lodging, lost wages, or any other expenses. 

5.3 We are not responsible for travel costs, hotel costs, lost wages, or other expenses related to schedule changes or cancellations. 

 

  1. In Person Attendance Requirements 

6.1 A professional kit is provided for in person programs. Additional materials may be requested prior to the program. If additional materials are requested, you are responsible for obtaining them unless we state in writing that they are included. 

6.2 You are responsible for your own travel, lodging, meals, and personal incidentals unless explicitly included. 

6.3 You agree to follow all studio, venue, and safety rules, including sanitation, tool handling, and professional conduct. 

6.4 We may deny entry or remove any participant for behavior that is disruptive, unsafe, harassing, discriminatory, intoxicated, or otherwise inappropriate, with no refund. 

 

  1. Assumption of Risk 

7.1 You understand that cosmetology education and hands on demonstrations involve inherent risks, including allergic reactions, scalp irritation, hair breakage, discomfort, burns, cuts, or other adverse outcomes.

7.2 You voluntarily assume all risks related to participation, including risks associated with tools, heated devices, adhesives, chemicals (if any), and close contact with others. 

7.3 You are solely responsible for ensuring that any technique you apply in your business complies with local laws, licensing rules, manufacturer instructions, and client suitability. 

 

  1. Educational Purpose Only, No Guarantees 

8.1 The Education Services are provided for educational and informational purposes only. 

8.2 We do not guarantee any particular outcome, including income, client growth, retention, speed of mastery, certification acceptance, business results, or stylist performance. Results depend on many factors outside our control. 

 

  1. Filming, Recording, and Permitted Personal Use 

9.1 Unless we state otherwise in writing for a specific program, you may film or photograph limited portions of the Education Services solely for your personal reference. 

9.2 You may not record in a way that captures confidential curriculum in full, captures proprietary demonstrations step by step for redistribution, or interferes with the class experience. 

9.3 You may not record other participants, clients, or staff without their express permission. 

9.4 We may restrict or revoke filming privileges at any time, in our sole discretion, including for privacy, intellectual property, or safety reasons. 

 

  1. Intellectual Property, Copyright, and License Restrictions 

10.1 All Education Services content is owned by HairByEster or its licensors and is protected by copyright, trademark, and other intellectual property laws. This includes, without limitation: curriculum, manuals, workbooks, worksheets, slides, videos, demonstrations, frameworks, terminology, course portal content, graphics, templates, and the HairByEster method and system (the HBE Method), whether registered or unregistered. 

10.2 Subject to your compliance with these Terms and full payment, we grant you a limited, revocable, nonexclusive, nontransferable license to access and use the materials for your own personal learning and your own behind the chair services. 

10.3 No teaching or training rights are granted. You may not use any portion of the Education Services to teach, train, certify, coach, mentor, or instruct any other person or group, whether paid or unpaid, in person or online. 

10.4 You may not copy, reproduce, distribute, publish, sell, sublicense, rent, loan, broadcast, upload, post, share, or create derivative works from any Education Services content. 

10.5 You may not share passwords, share downloads, screen record lessons, rehost videos, or distribute course materials in any format. 

10.6 We reserve the right to seek injunctive relief, damages, and all legal remedies available for violations. You agree that unauthorized use causes irreparable harm.

 

  1. Confidentiality and Non Distribution 

11.1 Certain content may be considered confidential and proprietary, including methods, processes, sourcing standards, blending systems, ratios, and internal operational guidance. 

11.2 You agree to keep such information confidential and not disclose it to others except as required by law. 

 

  1. Media Release for Our Use 

12.1 By attending or participating, you grant HairByEster permission to photograph, record, and use your name, likeness, voice, and images captured during the Education Services for marketing, advertising, education, and promotional purposes in any media, worldwide, without compensation. 

12.2 If you have a legitimate concern, you must notify us in writing before the program begins. We will make reasonable efforts to accommodate, but we cannot guarantee exclusion from background captures. 

 

  1. Health, Safety, and Communicable Illness 

13.1 You agree not to attend in person if you are ill in a way that could pose a risk to others. 

13.2 You understand that attendance in shared spaces carries inherent risk of exposure to communicable illness. You assume this risk. 

 

  1. Third Party Platforms 

14.1 We may deliver materials through third party platforms such as course hosting, payment processors, email service providers, analytics providers, and community tools. 

14.2 Your use of those platforms may also be subject to their separate terms and privacy policies. We are not responsible for third party systems, outages, or changes. 

 

  1. Termination and Access Suspension 

15.1 We may suspend or terminate your access immediately, without refund, if you violate these Terms, including intellectual property violations, login sharing, chargeback abuse, harassment, or disruption. 

15.2 Upon termination, your license ends and you must stop using all materials. 

 

  1. Disclaimer of Warranties 

THE EDUCATION SERVICES ARE PROVIDED AS IS AND AS AVAILABLE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON INFRINGEMENT.

 

  1. Limitation of Liability 

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HAIRBYESTER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOSS OF BUSINESS, LOSS OF DATA, OR BUSINESS INTERRUPTION. 

IN ANY EVENT, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE EDUCATION SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE APPLICABLE EDUCATION SERVICE IN THE SIX MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM. 

 

  1. Indemnification 

You agree to defend, indemnify, and hold harmless HairByEster and its owners, employees, contractors, and affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your participation, your conduct, your violation of these Terms, or your misuse of the Education Services. 

 

  1. Governing Law and Venue 

These Terms are governed by the laws of the State of New York, without regard to conflict of law rules. Any dispute will be brought exclusively in the state or federal courts located in New York County, New York, and you consent to jurisdiction and venue there. 

 

  1. Changes to These Terms 

We may update these Terms from time to time. The Last updated date reflects the most recent version. Continued use of the Education Services after updates constitutes acceptance of the revised Terms.
